Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

Biosecurity (Emergency Requirements - Remote Communities) Determination (No. 3) 2022

  • Makes requirements (referred to as remote communities’ requirements) to prevent or control the entry or spread of the listed human disease ‘human coronavirus with pandemic potential’ (COVID-19) in parts of Australian territory defined as designated areas.

Critical Worker Exemption from the Public Health (COVID-19 Self-Isolation) Order (No 4) 2021 (No 5)

  • Exempts a critical worker from Clauses 7A and 8 of the Public Health (COVID-19 Self-Isolation) Order (No 4) 2021 for the purpose of attending work, subject to certain conditions - came into force on 7 February 2022.


COVID-19 Directions (No. 36) 2022: Amendment to COVID-19 Directions (No. 33) 2022

  • Amends COVID-19 Directions (No. 33) 2022.

COVID-19 Directions (No. 37) 2022: Directions for Maritime Crew

  • Revokes COVID-19 Directions (No. 2) 2021 and amends COVID-19 Directions (No. 131) 2021.

COVID-19 Directions (No. 38) 2022: Revocation of COVID-19 Directions (No. 132) 2021 and Amendment of COVID-19 Directions (No. 131) 2021 and (No. 33) 2022

  • Revokes COVID-19 Directions (No.132) 2021 and amends COVID-19 Directions (No. 33) 2022 and COVID-19 Directions (No. 131) 2021.

COVID-19 Directions (No. 39) 2022: Amendment of COVID-19 Directions (No. 33) 2022

  • Amends COVID-19 Directions (No. 33) 2022.

COVID-19 Vaccination Requirements for Workers in a High-Risk Setting Direction (No. 2)

  • Specifies the COVID-19 vaccination requirements and related obligations for workers and employers operating in a high-risk setting.

Hospital Entry Direction (No. 11)

  • Sets the entry requirements for all hospitals and the requirements for collection of information, among other things.

Public Health and Social Measures Linked to Vaccination Status Direction (No. 3)

  • Outlines the requirements for businesses, activities and undertakings, including COVID-19 vaccination requirements for owners, operators, visitors and staff entering and remaining in businesses, activities and undertakings.

Workers in a Healthcare Setting (COVID-19 Vaccination Requirements) Direction (No. 3)

  • Sets out the COVID-19 vaccination requirements for workers in healthcare, their employers, and responsible persons in healthcare settings, with limited exceptions, to assist in containing the spread of COVID-19 in vulnerable settings, including health, disability and aged care settings, and in the broader community.

Approval by the Governor of Extension of a Major Emergency Declaration

  • Further extends the Declaration of a major emergency for a period of 28 days commencing on 5 February 2022.

Emergency Management (Appropriate Surgery During COVID-19 Pandemic No 8) Direction 2022

  • Ensures that healthcare resources are available to respond to the immediate needs of persons infected with COVID-19.

Emergency Management (Metropolitan Fire Service Vaccination) (COVID-19) Direction 2022

  • Maintains the provision of metropolitan fire services operating in the State of South Australia despite the presence of COVID-19 in the community, minimises the disruption to those services due the spread of COVID-19 amongst metropolitan fire service workers, minimises the disruption to those services due to metropolitan fire service workers being furloughed following possible exposure to COVID-19 and reduces the risk of the spread of COVID-19 by metropolitan fire service workers to venerable members of the community.

Pandemic COVID-19 Mandatory Vaccination (General Workers) Order 2022 (No. 3)

  • Requires employers to not permit general workers to work outside their homes if they not fully vaccinated or exempt, among other things - came into force at 11:59 pm on 4 February 2022.

Pandemic COVID-19 Mandatory Vaccination (Specified Facilities) Order 2022 (No. 4)

  • Requires operators of specified facilities to manage the vaccination status of workers, in order to limit the spread of COVID-19 within the population of residential aged care facilities, construction sites, healthcare facilities and education facilities, among other things - came into force at 11:59 pm on 4 February 2022.

Pandemic COVID-19 Mandatory Vaccination (Specified Workers) Order 2022 (No. 3)

  • Requires employers not to permit a worker to work outside their ordinary place of residence if they are unvaccinated or partially vaccinated or not fully vaccinated (boosted) (as applicable) in order to limit the spread of COVID-19 within the population of those workers - came into force at 11:59 pm on 4 February 2022.

Pandemic (Additional Industry Obligations) Order 2022 (No. 5)

  • Imposes additional specified obligations on employers and workers in specific industries (poultry processing facilities, abattoirs and meat processing facilities, seafood processing facilities, supermarket work premises and perishable food work premises, warehousing and distribution centres, commercial cleaning services, care facilities, ports of entry servicing international arrivals, hotel quarantine, hospitals, schools, childcare or early childhood services, construction sites) in relation to managing the risk of COVID-19 - came into force at 11.59 pm on 4 February 2022.

Pandemic (Open Premises) Order 2022 (No. 4)

  • Imposes obligations upon operators of certain open premises in Victoria and their patrons in relation to vaccination against COVID-19 and other requirements, in order to address the serious public health risk posed to Victoria by COVID-19 - came into force at 11:59 pm on 4 February 2022.

Pandemic (Quarantine, Isolation and Testing) Order 2022 (No. 5)

  • Requires persons to limit the spread of COVID-19 including by requiring persons who are diagnosed with COVID-19 or probable cases to self-isolate, or close contacts to self-quarantine and undertake testing, or exposed persons, social contacts or symptomatic persons in the community to observe relevant testing requirements issued by the Department - came into force at 11:59 pm on 4 February 2022.

Pandemic (Victorian Border Crossing) Order 2022 (No. 4)

  • Requires international arrivals to comply with the general post-entry conditions, restricts them from entering specific facilities for a period of time after entering Victoria, and requires them to carry and present specific documents on the request of an authorised officer, and requires international passenger arrivals to obtain a valid international passenger arrival permit, and complete prescribed COVID-10 PCR tests, among other things - came into force at 11:59 pm on 4 February 2022.

Pandemic (Workplace) Order 2022 (No. 4)

  • Restricts the number of Victorians attending work premises and imposes specific obligations on employers to assist in reducing the frequency of outbreaks of COVID-19 in Victorian workplaces - came into force at 11:59 pm on 4 February 2022.

Aircraft from Restricted Locations Arrival Directions (No 2)

  • Imposes requirements for owners and operators of aircraft and persons who have been in a restricted location.

Authorisation by the State Emergency Coordinator

  • Authorises border officers to give directions for the purposes of the COVID Transition (Border Requirements) Directions and any specified arrangement.

Chief Health Officer Approval to Request COVID-19 Testing on Persons Who Are Presenting to be Tested Under the COVID Restrictions (Adapted Household Contacts Quarantine and Presentation for Testing) Directions

  • Approves medical practitioners and persons duly and properly engaged to collect specimens to request a COVID-19 test as an approved requester in respect of any person that the requester has been reasonably satisfied is a person required to present to the COVID Clinic to comply with any requirement to present for testing required or created by the Covid Restrictions (Adapted Household Contacts Quarantine and Presentation for Testing Directions.

Chief Health Officer Approval to Request COVID-19 Testing on Persons Who Are Presenting to be Tested Under the Health Care Worker Directions

  • Approves medical practitioners and persons duly and properly engaged to collect specimens to request a COVID-19 test as an approved requester in respect of any person that the requester has been reasonably satisfied is a person required to present to the testing booth or COVID Clinic to comply with any requirement to present for testing required or created by the Health Care Worker Directions.

Chief Health Officer Approval to Request COVID-19 Testing on Persons Who Are Presenting to be Tested Under the Outbreak Outside of Western Australia Response Directions (No 21)

  • Approves medical practitioners and persons duly and properly engaged to collect specimens to request a COVID-19 test as an approved requester in respect of any person that the requester has been reasonably satisfied is a person required to present to the COVID Clinic to comply with any requirement to present for testing required or created by the Outbreak Outside of Western Australia Response Directions (No 21).

Chief Health Officer Approval to Request COVID-19 Testing on Persons Who Are Presenting to be Tested Under the Presentation for Testing Directions (No 38)

  • Approves medical practitioners and persons duly and properly engaged to collect specimens to request a COVID-19 test as an approved requester in respect of any person that the requester has been reasonably satisfied is a person required to present to the COVID Clinic to comply with certain provisions of the Presentation for Testing Directions (No 38).

COVID Transition (Border Requirements) Amendment Directions (No 3)

  • Amends the COVID Transition (Border Requirements) Directions.

DFES Interstate Firefighter Directions

  • Facilitates the entry to Western Australia of interstate firefighters and their undertaking of firefighting duties while preventing the importation or spread of COVID-19 into Western Australia.

Entry by Approved Border Community Residents and Workers Directions (No 2)

  • Allows approved border community residents and approved critical workers to enter or re-enter Western Australia in specified circumstances, while limiting the spread of COVID-19 in Western Australia.

Entry to Kimberley Directions (No 3)

  • Sets requirements for persons entering Western Australia via the Kimberley region.

Exposed On-board Worker Directions (No 3)

  • Sets out the requirements that apply to exposed on-board workers disembarking onto land in Western Australia.

Exposure Sites (Outside of Western Australia) Directions (No 4)

  • Requires persons who have visited an exposure site to quarantine immediately and present for testing, and requires certain information to be provided to the WA Police Force, among other things.

Flight Crew Directions (No 10)

  • Sets out the requirements that apply to a domestic flight crew member and an international flight crew member immediately after they enter Western Australia, and the entry requirements for those who are a close contact.

Health Care Workers Directions (No 3)

  • Facilitates the entry to Western Australia of health care workers from other State and Territories, while preventing the importation or spread of COVID-19 into Western Australia.

Maritime Crew Member Directions (No 3)

  • Sets out the requirements that apply to maritime crew members disembarking onto land in Western Australia.

Presentation for Testing Directions (No 39)

  • Prevents the importation of COVID-19 into Western Australia and otherwise limits the spread of COVID-19 in Western Australia.

Proof of Vaccination Directions (No 3)

  • Sets out vaccination and proof of vaccination requirements for certain premises in the State of Western Australia for the purposes of preventing, controlling or abating the risks associated with the State of Emergency.

Rig or Platform Crew Member Directions (No 3)

  • Sets out the requirements that apply to rig or platform crew members disembarking onto land in Western Australia.

Seasonal Workers Directions (No 2)

  • Sets out the requirements that apply to a seasonal worker immediately after they enter Western Australia.

Transiting Aircraft Passengers Directions (No 4)

  • Sets out the requirements that apply to a transiting aircraft passenger immediately after they enter Western Australia.

Transitional Travellers (Continuation of G2G Entry QR Codes) Directions

  • Provides for the continuation of certain G2G Pass Entry QR Codes during the transition from the Controlled Border for Western Australia to the COVID Transition (Border Requirements) Directions.

Transport, Freight and Logistics Directions (No 12)

  • Sets out the requirements that apply to a transport, freight and logistics driver who enters or intends to enter Western Australia.

COVID-19 Public Health Response (Protection Framework and Other Matters) Amendment Order 2022 Amendment Order 2022

  • Adjusts the amendments that will be made to the COVID-19 Public Health Response (Protection Framework) Order 2021 when the COVID-19 Public Health Response (Protection Framework and Other Matters) Amendment Order 2022 comes into force at 11.59 pm on 3 February 2022.

Epidemic Preparedness (Medicines Act 1981 - COVID-19) Immediate Modification Order 2022

  • Revokes and replaces the Epidemic Preparedness (Medicines Act 1981 - COVID-19) Immediate Modification Order 2021 and modifies the requirements imposed by the Medicines Act 1981 to enable the effective management of COVID-19 or its effects (or both).

Provisional Consent to the Distribution of a New Medicine

  • Provisionally consents to the sale, supply or use in New Zealand of the new medicine Nuvaxovid.

Revocation and Replacement of Authorisation of Persons to Import, Supply and Distribute Point-of-care Tests Under the COVID-19 Public Health Response (Point-of-care Tests) Order 2021

  • Authorises certain persons or classes or persons to import, supply, distribute, sell to other authorised persons or classes of persons, and use approved point of care rapid antigen tests.
